To ask the Minister for the Cabinet Office, for what reason his Department has not made a decision on the acquisition of Newport Wafer Fab by Vishay Intertechnology within its 30-working day target.

Given the quasi-judicial nature of the government’s investment screening powers, and for commercial confidentiality and national security reasons, it would be inappropriate to comment on any specific acquisitions or the potential applicability of the NSI Act 2021. Decisions are always made within the statutory timeframes required by the Act. Transparency is of course a crucial part of the NSI Act, and as such, the Government has published an Annual Report detailing the use of NSI Act powers. The report and notices of any Final Orders that have been made are available on GOV.UK.

ACOBA is an independent advisory Committee and publishes its advice online. I therefore refer the hon. Member to the relevant publications on GOV.UK.

The application of the Business Appointment Rules for civil servants and special advisers below Director General or equivalent is a matter for their employing department. Departments publish summary information in respect of individuals at SCS2 and SCS1 level, including special advisers of equivalent standing.

Question to the Cabinet Office:

To ask the Chancellor of the Duchy of Lancaster and Minister for the Cabinet Office, whether the Government plans to review the maximum fine that can be levied for breaching electoral law.

Answered by Kevin Foster

The Electoral Commission is the independent regulatory body responsible for ensuring that elections and referendums are run effectively and in accordance with the law.

The Commission has civil sanctioning powers that apply to referendums and elections. More serious criminal matters can and are referred to the police, and then considered by a court of law.

The Electoral Commission has recommended that its sanctioning powers be increased and the Government is considering this.
